Should I file a Chapter 7 Bankruptcy or Chapter 13 Bankruptcy? There are many variables to consider when attempting to answer this question. The first thing we have to look at is your and your spouse's income. When the bankruptcy laws were amended in 2005, Congress developed a "means test" to determine whether in a personal bankruptcy parties should be allowed to file a Chapter 7 bankruptcy or whether they should be required to file a Chapter 13 bankruptcy.
